FedEx Furniture is furniture put together by empty FedEx Boxes, and held together by fedex packaging supplies. All of the furniture seen here is 100% functional. The couch is standing/sleeping approved, I sleep on the bed every night, I eat at the dining table, and I work at the desk almost 20 hours a day.

Ick. I veto the "fresh law stories" theme for Monday morning. I'm guessing its just me, but I'm seriously about to purge from all the law binging I've had to do for the past 3 years. On that sweet note, graduation is just over 2 months away. Hallelujah.
It is interesting, though, that the response letter you linked to was written by one Jennifer Granick. She's quite a fine attorney that represented a guy that lived next door to C (remember the FBI raid soph. year? I remember waking up one morning to use the bathroom in my boxers and having to step through 4 agents standing post).
As an aside, I'm not so sure that Ms. Granick's citation (ΒΆ4) to Mattel v. Walking Mountain Pictures to analyze a copyright claim is the best analogy. That case involved both the parody and satire of Mattel's Barbie, which helped the court more comfortably find fair use. This case (arguably) doesn't appear to have either, although it doesn't really matter as fair use seems quite likely nonetheless given the transformative and noncommercial use and the miniscule effect on FedEx's market. It'll be interesting to see if FedEx pushes this one further.
